An invention is a new product or process that solves a technical problem. It differs from a discovery, which is something that already exists but has not yet been found.

what is a patent?

A patent is an industrial property right granted by an official authority. In Algeria, it is delivered by the Algerian National Institute of Industrial Property (INAPI). A patent protects innovations and gives its holder an exclusive right of use for a period of 20 years from the date of filing , as long as the fees are paid annually. This right allows the holder to manufacture, sell, export, or import the invention or the product resulting from it.

How to obtain an invention patent in Algeria?

Before submitting your application, it is recommended to conduct a prior art search to check for existing patents, subject to a fee of 2,400 DZD per search item.

Not considered as patents :

The following are not regarded as inventions and cannot be patented:

  • Scientific theories, principles, and discoveries, as well as mathematical methods
  • Plans, principles, or methods for performing purely intellectual or recreational activities
  • Teaching, organizational, administrative, or management methods and systems
  • Methods for treating the human or animal body through surgery or therapy, as well as diagnostic methods
  • Presentations of information
  • Computer programs
  • Creations with purely decorative purpose

Inventions patents cannot be granted for:

  • Plant varieties or animal breeds, as well as essentially biological processes for producing plants or animals.
  • Inventions whose implementation in Algerian territory would be contrary to public order or morality.
  • Inventions whose exploitation in Algerian territory would harm human or animal health, endanger plant life, or seriously damage environmental protection.
